By accessing or using MakingMoves.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and MakingMoves B.V., a company registered in the Netherlands ("MakingMoves.ai", "we", "us", "our"). By creating an account or using any part of the Service, you confirm that you are at least 16 years old and have the legal capacity to enter into this agreement.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Reproduce, distribute, or sell any content from the platform without written permission
• Use automated tools (bots, scrapers) to access or extract content
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Share your account credentials or allow others to use your account
• Upload malicious code, viruses, or any harmful content
• Impersonate any person or entity
• Use the Service for any commercial purpose without our written consent

6. Intellectual Property

All content on MakingMoves.ai, including practice tests, questions, explanations, AI coaching responses, company guides, publisher guides, design elements, and software, is owned by MakingMoves B.V. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial career preparation purposes. This license does not include the right to copy, modify, distribute, sell, or create derivative works from any content on the platform.

7. AI-Generated Content

MakingMoves.ai uses artificial intelligence to generate coaching feedback, practice questions, and personalized recommendations. You acknowledge that:

• !AI responses may contain errors or inaccuracies and should not be relied upon as professional career advice
• !We do not guarantee that preparation with our platform will result in a job offer or passing any specific assessment
• !The AI Tutor is not a substitute for professional career counseling

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• •Warranties of merchantability, fitness for a particular purpose, and non-infringement
• •That the Service will be uninterrupted, error-free, or secure
• •That any defects will be corrected
• •That the Service is free of viruses or other harmful components

Note: Some jurisdictions do not allow the exclusion of implied warranties. In such cases, the above exclusions apply to the maximum extent permitted by applicable law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKINGMOVES B.V. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater. These limitations apply regardless of the theory of liability.

You may terminate your account at any time by contacting ingmar@makingmoves.ai or using the account deletion feature in your settings.

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections 6 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 11 (Governing Law) survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands. For EU consumers, mandatory consumer protection laws of your country of residence also apply.

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts in Amsterdam, Netherlands, unless you are an EU consumer entitled to bring proceedings in your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and/or by posting a prominent notice on the platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
